These Terms of Service (“Terms”) are a legally binding agreement between you and Flynk AI LTD, a company registered in England and Wales (company number 17286617) with its registered office at 66 Paul Street, London, EC2A 4NA, United Kingdom (“Flynk AI”, “we”, “us”, “our”), governing your access to and use of Seen42, including our website, app, AI agent, hosted pages and related materials (collectively, the “Service”). By creating an account, subscribing, publishing a page or otherwise using the Service, you confirm that you have read, understood and agree to be bound by these Terms. If you do not agree, you must not use the Service.
If you use the Service on behalf of a company or other legal entity, you represent that you are authorised to bind that entity to these Terms, and “you” refers to that entity.
The Service is a business tool. We offer it to companies, sole traders, charities, public bodies and professionals acting for business purposes. If you nonetheless use the Service as a consumer, the consumer provisions in sections 4 and 14 apply to you, and nothing in these Terms limits rights that consumer law gives you and that cannot be waived.
2. The Service
Seen42 reads the website you add and runs automated checks of its pages. It asks AI assistants (such as ChatGPT, Perplexity, Gemini, Claude and Google AI Overviews, depending on your plan) the buyer questions you track (“prompts”). It shows which brands they name, in what position, and which sources they cite. Visibility checks run through Cite42, an AI search visibility service also operated by Flynk AI.
Seen42 drafts your first prompts and competitor list with AI models, and you can edit them. It collects company facts from your website and from documents you upload and uses them as found; you can edit or remove any of them. An AI agent drafts comparison, facts and guide pages from those facts and cited sources. On paid plans you can host approved pages on a Seen42 subdomain or (on plans that include it) your own subdomain, copy them as Markdown, HTML or plain text, or send them to your own website system. On paid plans, the same checks repeat every week.
We do not generate the answers of the AI assistants we check; they are produced by third-party systems. We may add, change, suspend or discontinue features, integrations or AI assistants. We aim to give reasonable advance notice of material changes that adversely affect paying customers, but we do not guarantee continuous availability of any particular feature or assistant.
3. Accounts and Eligibility
Minimum age: You must be at least 18 years old and legally able to enter into a binding contract.
Business use: The Service is intended for businesses and professionals promoting their own products, services or organisations.
Accurate information: You agree to provide true, current and complete information and to keep it up to date.
One account per person or entity: Creating multiple accounts to get around plan limits or the free check is prohibited.
Account security: You are responsible for keeping your sign-in credentials secure and for activity under your account. Tell us promptly at support@seen42.com if you suspect unauthorised access.
Sanctions and export controls: You represent that you are not located in, or a national or resident of, a country subject to comprehensive UK, EU or U.S. sanctions, and that you do not appear on any UK, EU, U.S. or UN restricted-party list.
Refusal: We may refuse registration, or suspend or terminate accounts, where we reasonably believe a user has breached these Terms or poses a risk to the Service, other users or us.
4. Plans, Billing and Payment
Current plans and limits are shown on our pricing page and in the app. At the date of these Terms they are:
Free (USD 0): one check of 10 prompts on ChatGPT and Gemini. It runs automatically after you sign up and is available once per website, across all accounts. Full results are shown for 3 prompts; the rest are shown locked. One answer-page draft per month. Publishing, copying and sending pages are not included.
Starter (USD 39 per month): 15 prompts checked weekly on ChatGPT, Perplexity, Gemini, Claude and Google AI Overviews, 5 new answer pages per month, 3,000 AI agent credits per month, and hosting on a Seen42 subdomain.
Growth (USD 89 per month): 25 prompts checked weekly on ChatGPT, Perplexity, Gemini, Claude and Google AI Overviews, 8 new answer pages per month, 6,000 AI agent credits per month, and hosting on your own subdomain.
Pro (USD 189 per month): 50 prompts checked weekly on ChatGPT, Perplexity, Gemini, Claude and Google AI Overviews, 15 new answer pages per month, 12,000 AI agent credits per month, and hosting on your own subdomain.
Every plan covers one site. Buying a paid plan starts weekly checks automatically. Checks also draw on a monthly usage allowance included in your plan; if it runs out, further checks wait until the allowance resets.
The Free plan includes 300 AI agent credits per month. One AI agent credit covers 1,000 model tokens read or written, including cached input. Chat, AI suggestions, page drafts, edits and conversation memory share this allowance, separately from visibility checks. Credits reset on the first of each calendar month (UTC) and do not roll over. We reserve credits before a request and count its reported usage when complete. Interrupted requests keep their reservation until usage is known. AI work pauses when the remaining allowance cannot cover the next request. We do not automatically charge for additional credits.
Subscriptions: Paid plans are monthly subscriptions billed in advance through Stripe and renew automatically each month until cancelled. By subscribing you authorise us, through Stripe, to charge your payment method for each period.
Changing plans: Upgrades take effect immediately and the prorated difference for the current period is charged at once. Downgrades take effect immediately, without a credit for the rest of the current period. If you track more prompts than the new plan allows, you must pause some before downgrading.
Cancellation: You can cancel from the billing portal in the app. Your plan then stays active until the end of the current billing period and is not renewed. Once a cancellation is scheduled, weekly checks stop.
When a paid plan ends: If your subscription ends or a payment fails, your account moves to the Free plan. Your published pages stay online for 30 days and are then taken offline. This 30-day period is not extended. Your drafts, your dashboard history and an export of your content remain available in your account. Pages you sent to your own website system stay there. Restoring a paid plan restores its features.
Price changes: We may change plan prices or limits. Price increases apply from your next billing period after at least 14 days’ notice by email or in the app; you may cancel before they take effect.
Refunds: Subscription fees are non-refundable except (a) where required by mandatory consumer-protection law, (b) where we agree in writing to a refund, or (c) where you were charged as a result of a verified error on our side.
Taxes: Prices are in US dollars. Where we are required to charge VAT or other taxes, they are shown at checkout.
Consumer right to cancel (cooling-off): If you are a consumer in the UK or EEA, you have a legal right to cancel a new subscription within 14 days without giving a reason. Because the Service starts as soon as you pay (weekly checks begin and your monthly allowance is made available at once), by subscribing you expressly request that we begin performing during the cancellation period and acknowledge that you lose the right to cancel once the Service has been fully performed. If you cancel within the 14 days before full performance, we refund the fee less a proportionate amount for the period during which the Service was provided. To cancel, email support@seen42.com or use the billing portal; you may use the model cancellation form in the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, but you do not have to.
Free plan: The Free plan and any free check are provided free of charge, as is, for evaluation. We may change, limit or withdraw them at any time without notice.
Usage allowances and fair use: Plan limits (prompts, assistants, new pages per month, pages of your website we read, agent messages and the monthly measurement allowance) are shown in the app. The agent and the checks run on metered third-party services. We may throttle or pause use that is far outside normal use for your plan, and we will tell you when we do.
Disputed charges: Please contact support@seen42.com before initiating a chargeback. Initiating a chargeback without contacting us first is a material breach of these Terms and may result in suspension. We respond to good-faith billing questions within five business days.
5. AI Answers and Drafted Content: No Guarantee
This section is important. Read it before relying on Seen42 results or publishing a draft.
Answers vary. AI assistants produce different answers on different days, across model versions and between runs. Seen42 records sampled answers. Mentions, citations, positions and trends are directional signals from those samples, not statements of fact about you, your competitors or your market.
No guaranteed outcome. We do not guarantee that any AI assistant or search engine will mention, cite or recommend you, or that publishing a page will change rankings, mentions, citations, traffic, leads or revenue. AI assistants choose their own answers and sources.
Citations are reported, not verified. Cited sources reflect what the AI assistant reports. Assistants sometimes cite pages that do not exist or do not support their answer.
Suggestions can be wrong. Prompts, competitor lists and company facts suggested by AI models, or found on your website or in your documents, can be wrong. Check them, and edit or remove any that are.
Drafts can be wrong. The Seen42 agent drafts from your company facts and the sources it cites, and Seen42 runs fact and source checks before publishing. These checks reduce errors but cannot guarantee that a page is accurate, complete or lawful. You must review every page before you publish, copy or send it.
Statements by AI assistants are theirs. What an AI assistant says about any person, brand or product is the statement of that assistant, not of Flynk AI. We provide a means of measuring public AI systems; we do not endorse their output.
Scores are estimates. Where the Service scores how an answer describes a brand (for example a sentiment score), the score is produced automatically from a sample of answers. It is an estimate for your information, not a measurement of reputation and not a statement about anyone.
Beta and preview features. Features marked beta, preview, experimental or similar may be incomplete, may change or be withdrawn without notice, and are used at your own risk.
No professional advice. Seen42 does not provide legal, financial, tax or other professional advice. Consult a qualified professional before acting on anything in an AI answer or a draft.
Our website and guides. Guides, comparisons and other information on our website and in the app are general information, not advice, and may be out of date. Details about other companies come from their own published pages on the date shown next to them. If you represent a company named on our website and believe something is inaccurate, email support@seen42.com with the page address and we will review and correct it promptly.
6. Your Content and Published Pages
Your website. Only add a website that you own or are authorised to represent. By adding it, you allow us to fetch its public pages, robots.txt and sitemap, and to re-check its pages about once a week, as described in our Privacy Policy.
Documents you upload. Only upload documents you have the right to share with us. Do not upload special-category personal data or personal data about private individuals. We keep only the text we extract from a document, not the file. You can delete uploaded documents at any time.
Your responsibility. You are responsible for the company facts in your account, the pages you publish, copy or send, and everything they say, including statements about competitors, prices and features. Comparative claims must be accurate, fair and verifiable, and you must have the right to use any text, images, logos and trade marks you include.
Publishing. Pages are published only when you approve them. Nothing is published automatically.
You are the publisher. Pages you approve are published at your direction. You, not Flynk AI, are the publisher of each page and responsible for it under defamation, advertising, consumer-protection, intellectual-property, data-protection and other applicable law. We host your pages as an intermediary and do not review them before publication.
Comparisons and competitors. Pages that name or compare other businesses must comply with the law on comparative advertising and trade marks, including in the UK the Business Protection from Misleading Marketing Regulations 2008 and the Trade Marks Act 1994 and in the EU Directive 2006/114/EC. Details about other businesses must be accurate, current and verifiable, and their names and marks may be used only to identify them, never to suggest endorsement or affiliation. The Service records a source and date for competitor details it drafts; you must check them before publishing and update or take down a page when the facts change.
Copying and sending pages. On paid plans you can copy pages as Markdown, HTML or plain text, or send them to your own website system (WordPress, Webflow, Shopify, Ghost or a webhook URL). Pages you copy or send are published on your website under your control. Pages sent to your website system arrive as drafts unless you choose to publish them straight away.
Website-system credentials. To send pages, you give us credentials for your website system, such as a WordPress application password or an API token. You must be authorised to give them to us. We store them encrypted, use them only to create or update the posts you send, never show them again, and delete them when you disconnect or close your account. Pages you have already sent stay in your website system.
Your domain. If you connect your own subdomain, you must control it and keep the required DNS records in place. We are not responsible for availability problems caused by changes to your DNS.
Integrations you add. Analytics, tag-management, advertising, comment and cookie-consent tools you add to your pages are configured by you. You are responsible for any notices and consents those tools require.
Removal. We may take down or refuse to host a page that we reasonably believe is unlawful, infringing, misleading or in breach of these Terms, and will tell you when we do so unless the law prevents us.
Complaints about a page (notice and takedown). Anyone who believes a page hosted by Seen42 is unlawful, defamatory or infringes their rights can email support@seen42.com with the page address, the specific statements complained of and the reason. We assess notices promptly and may remove or disable access to the page, in whole or in part, while we do. We will tell you about the notice and give you a chance to respond unless the law prevents us. We may terminate accounts that repeatedly publish infringing or unlawful content.
7. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not, and must not permit anyone using your account to:
7.1 General prohibitions
use the Service in violation of any applicable law, regulation, court order or third-party right, including intellectual property, privacy, consumer-protection, advertising and competition law;
publish or generate content that is defamatory, threatening, harassing, hateful, sexually exploitative, promotes violence or self-harm, or is otherwise unlawful;
reverse engineer, decompile or attempt to discover the source code or non-public interfaces of the Service, except where the law expressly permits it;
probe, scan or test the vulnerability of the Service, or circumvent any security, authentication or usage limit, without our prior written authorisation;
interfere with the integrity or performance of the Service, or use it at a rate or in a pattern that is abusive;
sell, rent or share access to your account with anyone outside your organisation;
use the Service in a way that breaches the terms or usage policies of the AI assistants and model providers we rely on, which apply to traffic you originate through the Service.
7.2 Specific prohibitions
No targeting of private individuals. Prompts, facts and pages must concern brands, products, organisations and public topics. You must not use the Service to profile, analyse or publish content about identifiable private individuals.
No impersonation or misleading pages. You must not publish pages that impersonate another person or business, misrepresent your affiliation, or make false or unsubstantiated claims about competitors.
No manipulation at scale. You must not use the Service to mass-produce low-value pages, hidden text or prompt-injection content whose main purpose is to manipulate AI assistants or search engines rather than to inform readers.
No use against Seen42 itself. You must not try to extract our system prompts, internal logic, costs or other confidential operational details.
We may monitor usage to enforce these rules, consistent with our Privacy Policy.
8. Intellectual Property
Your content. You keep all rights you hold in the website content, company facts, prompts, documents, images and other material you provide (“Your Content”). As between you and us, the pages you publish through Seen42 belong to you. You grant Flynk AI a worldwide, non-exclusive, royalty-free licence to host, process, transmit, adapt, publish and display Your Content and your pages solely as necessary to operate the Service, including sending it to the providers described in our Privacy Policy, serving your published pages and sending pages to website systems you connect.
Results. You may use your visibility results and reports for your own business purposes. They derive from third-party AI systems whose terms may also apply.
Our property. Except for Your Content, the software, design, templates, documentation, logos and marks that make up the Service are owned by Flynk AI LTD or its licensors. We reserve all rights not expressly granted.
Feedback. If you send us feedback or suggestions, you grant us a perpetual, irrevocable, royalty-free licence to use it without obligation to you.
9. Privacy and Data Processing Terms
Our handling of personal data is described in our Privacy Policy and Cookie Policy, which form part of these Terms. For your account, billing and usage data, Flynk AI is the controller. For personal data contained in Your Content or in pages you publish (for example a named contact on your website or in a document you upload), you are the controller and Flynk AI is your processor. The following terms apply to that processing and are intended to meet Article 28 of the UK GDPR and EU GDPR.
Subject matter and duration: processing of personal data in Your Content and pages for the purpose of providing the Service, for as long as you have an account and for the retention periods in the Privacy Policy.
Your instructions: we process that data only to provide the Service as configured by you and as described in these Terms and the Privacy Policy, and otherwise only on your documented instructions, unless the law requires otherwise, in which case we tell you first where we are allowed to.
Your responsibilities: you confirm that you have a lawful basis for the personal data you provide, that it is limited to what the Service needs, and that it does not include special-category data or data about private individuals, as section 7 requires.
Confidentiality and security: people who process the data for us are bound by confidentiality, and we apply the technical and organisational measures described under Security in the Privacy Policy.
Subprocessors: you authorise the service providers listed in the Privacy Policy. We will give at least 14 days’ notice by email or in the app before adding or replacing one; if you object on reasonable data-protection grounds and we cannot resolve the objection, you may end your subscription and we will refund any prepaid fees for the remaining period. We remain responsible for our subprocessors’ performance.
International transfers: transfers outside the UK or EEA are made under the safeguards described in the Privacy Policy.
Assistance: taking into account the nature of the processing, we help you respond to data-subject requests and meet your security, breach-notification and impact-assessment obligations, at your reasonable cost where the request goes beyond the features of the Service. We notify you without undue delay after becoming aware of a personal data breach affecting your data.
Deletion and return: you can export your pages and results from the app at any time. When your account is closed we delete or anonymise personal data as described in the Privacy Policy, except where the law requires us to keep it.
Information and audit: on written request, no more than once a year, we provide the information reasonably needed to demonstrate compliance with these terms, such as our subprocessor list, security summary and relevant certifications of our hosting providers. An on-site audit is available only where a supervisory authority requires it or a confirmed breach affects your data, on reasonable notice, at your cost and under confidentiality.
Liability: each party’s liability under these data processing terms is subject to section 11, except where the UK GDPR or EU GDPR provides otherwise.
If you need a separately signed data processing agreement, email support@seen42.com.
10. Disclaimer of Warranties
THE SERVICE, ALL RESULTS AND ALL DRAFTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, FLYNK AI DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY AND UNINTERRUPTED OR ERROR-FREE OPERATION.
IN ADDITION TO SECTION 5, WE DO NOT WARRANT THAT (A) THE SERVICE WILL MEET YOUR REQUIREMENTS, (B) THE SERVICE WILL BE AVAILABLE AT ANY PARTICULAR TIME, (C) ANY RESULT OR DRAFT WILL BE ACCURATE, COMPLETE, NON-INFRINGING OR REPRODUCIBLE, OR (D) ANY THIRD-PARTY AI ASSISTANT OR MODEL PROVIDER WILL CONTINUE TO BE AVAILABLE.
Some jurisdictions do not allow the exclusion of certain warranties. To the extent such laws apply, these exclusions apply only to the maximum extent permitted, and your statutory rights as a consumer (if any) are unaffected.
No service level. We do not commit to any uptime, response time or support response time unless a separate written agreement says so. We may take the Service offline for maintenance and will try to do so outside UK business hours. The Service depends on third-party AI assistants, model providers and payment, hosting and email providers that we do not control, and it may be interrupted when they are.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL FLYNK AI LTD (INCLUDING ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS AND LICENSORS) BE LIABLE FOR:
ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES;
LOST PROFITS, REVENUE, SAVINGS, BUSINESS OPPORTUNITIES OR GOODWILL, LOSS OF DATA, OR THE COST OF SUBSTITUTE SERVICES;
ANY DAMAGES ARISING FROM YOUR RELIANCE ON A RESULT, OR FROM A PAGE YOU PUBLISHED, INCLUDING ANY ALLEGEDLY DEFAMATORY, INFRINGING OR INACCURATE CONTENT;
ANY DAMAGES ARISING FROM A THIRD-PARTY PROVIDER’S OUTAGE, LIMITS, POLICY ACTION, OR CHANGE IN PRICING OR AVAILABILITY;
ANY DAMAGES ARISING FROM UNAUTHORISED USE OF YOUR ACCOUNT WHERE WE WERE NOT NEGLIGENT.
REGARDLESS OF THE LEGAL THEORY ON WHICH ANY CLAIM IS BASED, OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID FLYNK AI FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY, OR (B) USD ONE HUNDRED ($100).
Sole remedy. Your only remedies for a defect in the Service are, at our option, correction of the defect, re-performance of the affected check or page, or a refund of the fees you paid for the affected period.
Time limit for claims. To the extent permitted by law, any claim arising out of or related to the Service must be brought within twelve (12) months after the event giving rise to it, after which it is barred.
Reasonableness. You acknowledge that the fees reflect this allocation of risk, that the Service measures and drafts from third-party AI systems whose output neither party controls, and that these limits are reasonable given the nature and price of the Service.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, and any other liability that cannot be excluded under the laws of England and Wales.
12. Indemnification
You agree to defend, indemnify and hold harmless Flynk AI LTD, its officers, directors, employees, agents and licensors from and against any third-party claim, demand, loss, liability, fine or expense (including reasonable legal fees) arising out of or relating to:
Your Content, your published pages, or your use of any result;
your breach of these Terms, any applicable law or any third-party right, including defamation, privacy, intellectual-property, advertising and competition-law claims;
integrations or tools you add to your published pages;
any claim by a business, brand or person named in your prompts, facts or pages;
your failure to comply with data-protection law as controller of personal data in Your Content or your pages.
We will give you prompt written notice of any such claim and reasonable cooperation at your expense. We may assume the exclusive defence and control of any matter for which you owe us indemnification, in which case you agree to cooperate. You will not settle any matter affecting our rights without our prior written consent.
13. Suspension and Termination
By you. You can cancel your subscription at any time as described in section 4, or close your account in Settings. Closing your account ends any subscription immediately, takes your published pages offline, stops scheduled checks and deletes the credentials we store for your website system. Pages you sent to your own website system stay there. Fees already paid are not refunded except as set out in section 4.
By us. We may suspend, restrict or terminate your account, in whole or in part, if we reasonably believe that:
you have breached these Terms, in particular sections 6 and 7;
your account or use of the Service is unlawful or fraudulent, or threatens the security or integrity of the Service, other users or third parties;
continuing to provide the Service would cause us to breach a law, regulation, court order, sanctions regime or obligation to a provider;
you initiate a chargeback inconsistent with section 4.
Where reasonable, we will tell you before suspending your account and give you a chance to fix the problem. Before closing your account, export your pages and results from the app. On termination, your right to use the Service ends; we delete or anonymise your data as described in the Privacy Policy and may keep aggregated, de-identified statistics. Sections 5, 6, 8, 9, 10, 11, 12, 14 and 15 survive termination.
14. Governing Law and Dispute Resolution
Talk to us first. Before starting any proceedings, you agree to email support@seen42.com with a description of the dispute and to try in good faith to resolve it with us for 30 days. We will do the same before starting proceedings against you.
These Terms and any dispute arising out of or in connection with them (including non-contractual disputes) are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that each party may seek injunctive relief in any competent court to prevent irreparable harm.
If you are a consumer resident in the EEA, you keep the benefit of any mandatory consumer-protection rights of your country of residence and may bring proceedings in your local courts where the law requires.
15. Miscellaneous
Entire agreement: These Terms, with the Privacy Policy and Cookie Policy, are the entire agreement between you and us regarding the Service.
Non-reliance: You confirm that you have not relied on any statement, promise or representation that is not set out in these Terms, including statements on our website, in our guides or by the Seen42 agent, and that your only remedies for any such statement are for breach of these Terms. Nothing in this clause limits liability for fraud.
Interpretation: Headings are for convenience only; “including” means “including without limitation”; references to law include that law as amended or replaced.
Language: These Terms are written in English. Any translation is for convenience; the English version prevails.
Severability: If any provision is held unenforceable, it will be modified to the minimum extent necessary or severed, and the rest remains in effect.
No waiver: Our failure to enforce a provision is not a waiver of our right to enforce it later.
Assignment: You may not assign these Terms without our prior written consent. We may assign them to an affiliate or to a successor in a merger, acquisition or sale of substantially all assets.
Independent parties: Nothing in these Terms creates a partnership, joint venture, agency or employment relationship.
Third parties: Except for our affiliates, officers, directors, employees and licensors (who may rely on the disclaimers, limitations and indemnities), these Terms create no third-party rights, and the Contracts (Rights of Third Parties) Act 1999 does not otherwise apply.
Force majeure: We are not liable for failure or delay caused by events beyond our reasonable control, including outages of third-party services and AI providers, cyberattacks, natural disasters and governmental action.
Notices: We may give notice by email to the address on your account or in the app. Notices to us must be sent to support@seen42.com.
16. Changes to These Terms
We may revise these Terms. Material changes are announced at least 14 days before they take effect, by email and in the app. The “Last updated” date above reflects the most recent revision. If you do not agree to the updated Terms, you may cancel and close your account before they take effect.
